Important Notice
For digital content such as license keys, the right of withdrawal is lost only once all conditions of Art. 38(1)(13) of the Polish Consumer Rights Act are met: your prior express consent to immediate delivery, notice of the loss of the right of withdrawal, and confirmation of both in your order confirmation email.
Your Statutory Right of Withdrawal
As a consumer in the European Union, you have the right to withdraw from a distance purchase contract within 14 days without giving any reason.
The withdrawal period expires after 14 days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of an unequivocal statement (e.g., email to support@lizensa.eu).
Exception for Digital Content
Pursuant to Art. 38(1)(13) of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent, given before the withdrawal period has expired, and after the consumer has been informed by the Seller of the resulting loss of the right of withdrawal.
Note: delivery of the licence key itself (e.g. the email containing the key) does not by itself trigger the loss of the right of withdrawal. That loss only occurs once all of the following are met: (1) the Consumer gave express consent to the start of performance before the withdrawal period expired; (2) the Consumer was informed of the loss of the right of withdrawal; (3) confirmation of that consent and information is included in the order confirmation email.
This exception applies to licence keys sold on Lizensa only where the above conditions are met cumulatively.
How It Works at Lizensa
During checkout, you will be asked to expressly confirm:
1. You request that performance of the digital content (licence key delivery) begin before the 14-day withdrawal period expires; 2. You have been informed that, once performance begins, you lose the right of withdrawal under Art. 38(1)(13) of the Polish Consumer Rights Act; 3. You acknowledge that confirmation of this consent and information will be sent in the order confirmation email.
Consent is collected separately during checkout (via a checkbox). Confirmation that it was given, and of the information about the loss of the right of withdrawal, is included in the order confirmation email.
How to Exercise Withdrawal
